Court nullifies NBC’s power to impose fines on broadcast stations

The Federal High Court, sitting in Abuja,  yesterday declared as ‘null and void’ the provisions of the Nigeria Broadcasting Code, authorising the National Broadcasting Commission (NBC) to impose fines on broadcast stations for alleged breaches of the Code, as it ruled that administrative and regulatory bodies could not exercise judicial powers. Court refuses to vacate judgment barring NBC from enforcing fines on broadcast stations

The Federal High Court in Abuja, yesterday, struck out the National Broadcasting Commission (NBC) application for an order setting aside its judgment preventing it from imposing fines on broadcast stations in the country. In his decision, Justice James Omotosho dismissed all of NBC’s arguments, calling them “an afterthought”.
