Uncertainty surrounds the planned trial of officers accused of plotting a coup against President Bola Tinubu, as the Federal Government has yet to decide whether they will face a court-martial or be arraigned in a civilian court.

According to a published report yesterday, the federal government had not given instruction on whether the suspects should be court-martialled or arraigned in a regular court.

Recall that 16 senior officers were arrested in October 2025, alongside about 24 others, over the alleged plot. While the Defence Headquarters later confirmed their arrest for coup-related offences and announced plans to try the military suspects before relevant military judicial panels, proceedings have stalled amid reported disagreement between military authorities and the Presidency over the appropriate legal forum.

Sources within the military said investigations had been concluded and the suspects would be arraigned soon, but noted that the final decision rests with the President as Commander-in-Chief. 

Officials in the Federal Ministry of Justice also acknowledged “confusion” over jurisdiction, describing the case as unprecedented under a democratic government.

Human rights lawyer, Femi Falana (SAN), argued that only the Federal High Court has jurisdiction to try alleged coup plotters under the Constitution, warning that any court-martial decision would be nullified. He also faulted the continued detention of suspects, insisting they should be promptly arraigned or released in line with constitutional provisions.
